IN PERSON PRIVATE LESSON TERMS AND CONDITIONS
By booking and participating in a private lesson with Italia Moore (“Instructor”), the Client (or Parent/Legal Guardian if participant is under 18) agrees to the following Terms & Conditions:
1. Assumption of Risk & Release of Liability
Dance instruction and physical training involve inherent risks, including but not limited to:
Muscle strains, sprains, tears
Slips and falls
Joint injury
Head injury
Aggravation of pre-existing conditions
Other unforeseen physical injuries
Client understands and voluntarily assumes all risks associated with participation in private lessons.
Client releases and holds harmless Italia Moore, Italia Moore LLC, and any affiliated contractors from any and all claims, demands, damages, causes of action, or liability arising out of participation in private lessons.
Client confirms they are physically able to participate and will notify Instructor of any injuries, limitations, or medical conditions prior to the lesson.
2. Studio Space & Premises Disclaimer
Private lessons may take place in third-party studios or rented facilities.
Italia Moore is not responsible for:
The condition of studio floors
Building maintenance
Equipment provided by the studio
Safety of the premises
Parking areas or exterior grounds
Any claims related to the physical premises must be directed to the facility owner or operator.
If the studio requires separate waivers, Client agrees to complete them.
3. Medical Emergency Authorization
In the event of a medical emergency, Client authorizes Instructor to seek medical treatment if necessary. Client agrees to be financially responsible for any medical expenses incurred.
4. Payment Policy
Private lessons are not confirmed or reserved until full payment is received.
Payment must be made in advance.
Accepted payment methods: Venmo, Apple Pay, Zelle, Cash App, Credit/Debit Card.
All sales are final.
5. Cancellation & Refund Policy
Client Cancellations:
No refunds for cancellations.
Credit may be issued for cancellations made at least 24 hours prior to the scheduled lesson.
Credits must be used within 30 days of issue.
Cancellations made less than 24 hours before the lesson will result in forfeiture of payment.
No-shows result in forfeiture of payment.
If Client is more than 15 minutes late without communication, the lesson may be cancelled and no refund or credit will be issued.
Instructor Cancellations:
If Instructor cancels, Client may choose:
A full refund, or
A rescheduled lesson at no penalty.
6. Tardiness Policy
Lessons begin and end at the scheduled time.
If Client arrives late, the lesson will still end at the originally scheduled time.
Lost time due to Client lateness will not be extended.
If Instructor arrives late, the lesson will be extended accordingly or a time adjustment will be made.
7. Duration of Session
Each private lesson will conclude at the agreed-upon end time. There are no extensions beyond the scheduled duration unless pre-approved.
8. Media Release
Client grants Italia Moore and Italia Moore LLC permission to photograph and/or record video during lessons.
These materials may be used for:
Social media
Marketing
Website content
Promotional materials
Portfolio use
If Client does not consent to media use, written notice must be provided prior to the lesson.
No compensation will be provided for media usage.
9. Intellectual Property
Choreography, combinations, concepts, and training methods taught during private lessons remain the intellectual property of Italia Moore.
Client may not:
Teach the choreography to others for profit
Record and distribute choreography
Sell or reproduce material without written permission
10. Independent Contractor Status
Instructor operates as an independent contractor. Participation in private lessons does not create any partnership, employment, or agency relationship.
11. Behavior & Conduct
Instructor reserves the right to refuse or discontinue lessons if Client engages in:
Unsafe behavior
Disruptive conduct
Harassment
Failure to follow instruction
No refund will be issued in such cases.
12. Minors
If participant is under 18:
A parent/legal guardian must sign this agreement.
Parent acknowledges and accepts all risks on behalf of the minor.
